Previously, by Article 6, Paragraph 4 of the nationality law, individuals seeking Portuguese nationality through naturalization needed to fulfill various conditions, including residing in Portugal for a minimum of five years.
The commencement of the five years for nationality eligibility was dependent on obtaining the initial residency permit.
With the recent legislative update, the revised Article 15 now includes Paragraph 4 of the nationality law, clarifying that the duration between applying for the temporary residency permit and its eventual approval will count towards the calculation of the mandatory residency period for nationality, provided the residency permit is conferred.
By the recent amendments to the Nationality Law, the residency period is set to commence from the date of application for the resident permit. Essentially, expressing interest in acquiring a residence permit in Portugal constitutes an application for a Resident Permit.
The proposed law, which received widespread consensus during voting, is anticipated to undergo the finalization of its wording before being forwarded to the President for ratification and subsequent publication in the official gazette. These changes are scheduled to come into effect on the first day of the month following their publication in the Official Gazette, presumably starting from February 1, 2024.
